Welcome to Arizona Brew Hopping! By participating in our brewery tours, you agree to the following Terms and Conditions, which are designed to ensure a safe, enjoyable, and responsible experience for all Participants. Please read these terms carefully before booking your tour.
The Basics:
Brewery tours, brewery hopping and alcohol consumption are adult activities and the choice to participate is an adult choice which comes with adult responsibilities and risks. If you choose to participate, you are expected to be a polite, responsible adult who accepts the inherent risks of this activity. If you choose not to act in this manner, you will be ejected from the tour without compensation.
Eligibility for Participation
Participants must be at least 21 years of age with valid government-issued identification.
All Participants agree to an ID scan to verify legality of alcohol sales and state compliance requirements
Arizona Brew Hopping and the Brewery vendors reserves the right to refuse service or deny participation to any individual, including but not limited to, those who are underage, visibly intoxicated, causing disruption, or deemed unfit to participate in the tour for any reason.
Assumption of Risk and Liability Waiver
Physical, Material, and Emotional Damages: By participating in the Arizona Brew Hopping tour, Participants acknowledge and accept the inherent risks associated with visiting breweries, consuming alcohol, and traveling between venues. These risks may include, but are not limited to, slips, falls, accidents, injuries, or loss of personal property.
Waiver of Liability: Arizona Brew Hopping, its employees, contractors, affiliates, and brewery partners (collectively referred to as "the Company") shall not be held liable for any physical, material, or emotional damages arising from participation in the tour. This includes, but is not limited to, injuries, accidents, loss of property, negligence, or emotional distress resulting from participation in the tour, activities at the brewery locations, or activities that happen after the tour concludes.
By booking and/or participating (hereafter referred to as ‘Participant(s)’) in a tour with Arizona Brew Hopping, the individual making the reservation ("the Signer") and any tour Participants acknowledge and assume all risks associated with the activities of the tour, including but not limited to transportation, brewery visits, alcohol consumption, slips, falls, accidents, injuries, property loss, and emotional distress.
The Signer/the Participant agrees to waive, release, and hold harmless Arizona Brew Hopping, its owners, employees, contractors, brewery partners, affiliates, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or harm (physical, material, or emotional) suffered by any member of their party.
The Signer further represents that they have the authority to bind all members of their party to this waiver and that all Participants have been informed of and agree to the Terms and Conditions.
Participation in the tour is voluntary, and all Participants/Signers acknowledge they are assuming full responsibility for their own safety and actions, as well as the safety and actions of their party.
Responsibility for Personal Safety
Participant’s Responsibility: Participants are responsible for their own safety and well-being throughout the duration of the tour, must exercise caution when walking through brewery premises, boarding and disembarking vehicles, traversing parking lots, and consuming alcohol.
Lost Items: Arizona Brew Hopping is not responsible for lost or stolen items during the tour, at pickup/drop-off locations, or at any of the breweries visited.
Brewery Partner Liability Protection
Arizona Brew Hopping works with local breweries to provide a unique and enjoyable experience. The Company, their staff, and their premises are protected from any claims or lawsuits initiated by the Participants or The Signer related to, but not limited to, injuries, accidents, loss of property, or emotional distress that occur during the tour or while on brewery premises.
Obligation to Follow Staff Instructions
All Participants/Signers agree to follow the instructions of Arizona Brew Hopping tour staff and brewery staff at all times during the tour. Failure to comply may result in removal from the tour without refund or compensation of any kind.
Refusal of Service and Removal from Tour
Right to Refuse Service: Arizona Brew Hopping and its brewery partners reserve the right to refuse service to any Participant, including but not limited to, individuals who are:
Under the age of 21
Visibly intoxicated or otherwise impaired
Behaving in a disruptive, disrespectful, or unsafe manner
Removal from Tour: The Company reserves the right to remove any Participant from the tour at any point without refund, without return transportation, nor compensation if the individual meets any of these reasons:
Refuses to follow the instructions of tour guides or staff
Engages in behavior that endangers the safety of other Participants, brewery staff, or patrons
Exhibits abusive, threatening, or harassing behavior toward other Participants, brewery staff, or patrons (this includes physical, sexual, and emotional abuse)
Compensation for Damages
The Company reserves the right to pursue monetary compensation from any Participant or Signer who causes damage to tour property, vehicles, brewery premises, or equipment, as well as personal injuries to other Participants, staff, or brewery and tour patrons.
Participants and Signers who vomit, expel excrement, or otherwise soil the tour vehicle will be charged a mandatory cleaning fee of $350 to cover professional cleaning cost and sanitization. This fee will be charged directly to the Participant responsible, or to the booking party Signer if the responsible individual cannot be identified.
Arizona Brew Hopping reserves the right to pursue additional compensation for damages to the vehicle or any other property caused by Participants during the tour.
Legal and Criminal Actions
The Company reserves the right to pursue legal and criminal actions against any Participant or Signer whose behavior endangers the business, staff, customers or Participants of the tour company and/or brewery. This includes but is not limited to, physical harm, threats, harassment, or acts that damage property or disrupt the operation of the business.
No Refund Policy
Refunds will not be provided for Participants who are refused service or removed from the tour due to non-compliance with the Terms and Conditions.
Alcohol Consumption
Responsibility: Participants are encouraged to drink responsibly and in moderation during the tour. The Company is not responsible for any incidents, injuries, or damages resulting from excessive alcohol consumption.
The Company reserves the right to limit or restrict alcohol consumption for any Participant who appears intoxicated. Any Participant who becomes or appears excessively intoxicated or visibly impaired may be asked to leave the tour without refund, and no further alcoholic beverages will be served to them. This determination is made at the discretion of Arizona Brew Hopping staff and/or Brewery vendors’ staff.
By participating in the Arizona Brew Hopping tour, Participants acknowledge that their blood alcohol content (BAC) may exceed the legal limit for driving which is 0.08 in the state of Arizona. Participants agree not to operate a motor vehicle under any circumstances if intoxicated above the legal limit.
Participants agree to submit to a breathalyzer test at the discretion of The Company staff, if deemed necessary to ensure safety. Refusal to comply may result in removal from the tour without refund.
The Company is not liable for the actions or decisions of Participants, including but not limited to, damages caused by Tour Participants or the choice to drive while intoxicated.
If intoxicated, Participants agree to arrange alternative transportation, such as using a rideshare service, calling a designated driver, or taking a taxi. It is the sole responsibility of the Participant to ensure they travel home safely. The Participant agrees not to hold The Company responsible for any actions once they are dropped off at their final destination after the tour.
Hydration and Nutrition
Participants are responsible for ensuring adequate hydration and nutrition prior to the start of the tour and throughout the tour. While food is provided by Arizona Brew Hopping at one stop during the tour, it is not intended to replace a full meal. Participants are encouraged to eat a substantial meal before joining the tour to help moderate alcohol absorption and ensure a more enjoyable experience.
Transportation
The transportation provided by Arizona Brew Hopping is part of the overall tour experience. The Company is not liable for any accidents, injuries, or damages that occur while Participants are being transported between brewery locations.
Compliance with Local Laws
Participants must adhere to all local, state, and federal laws during the tour. Any illegal activity, including but not limited to, underage drinking, public intoxication, or drug use, will result in immediate removal from the tour and potential legal action.
Modifications to the Terms and Conditions
Arizona Brew Hopping reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is the responsibility of the Participants to review these terms prior to the start of each tour.
Photographs and Media Release
By participating in the Arizona Brew Hopping tour, Participants grant permission for photographs, videos, or other media featuring their image and likeness to be taken during the tour. Arizona Brew Hopping reserves the right to use these images and recordings in its social media posts, website, advertisements, and other promotional materials.
By booking and participating in the tour, Participants agree to the use of their image and likeness for Arizona Brew Hopping’s marketing and promotional purposes, without compensation, and waive any rights or claims related to the use of such media.
Cancellation Policy
Standard Tours: Standard tour individual tickets are non-refundable if canceled within 24 hours of the scheduled tour start time. Cancellations made more than 24 hours in advance may be eligible for a full refund.
Private Tours: Private tours cannot be canceled within 5 days of the scheduled tour start time. Cancellations made more than 5 days in advance are eligible for a 50% refund. No refunds will be provided for cancellations within the 5-day window before the tour.
Private tour refund requests must be submitted in writing to Arizona Brew Hopping through email or the contact form on the company’s website.
By booking and participating in the Arizona Brew Hopping tour, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety.
